Terms & Conditions
| Price increase:
| The price may be increased by the seller in accordance with the conditions at the date of actual delivery and the customer shall pay such increase, such conditions include, but are not limited to changes in the manufacturer’s price, rates of exchange, government regulations, levies and/or duties, shipping freight rates and transport rates. Such price increase shall be communicated prior to having the same effected. | |
| Delivery:
| (a) Delivery will be at the seller’s place of business unless otherwise negotiated and agreed in writing. (b) Notwithstanding delivery, ownership of goods shall not pass to the buyer until full payment has been received by the seller. | |
| Claims:
| All claims for damages and/or shortages are to be made by the buyer within 3 days (three) after delivery of goods. No claims of any nature will be accepted after the three-day allowable period. | |
| Returned goods:
| The company will not accept the return of any goods for any reason unless it is agreed in writing prior to the return of such goods. For any returns due to short expiry, such returns must be made six (6) months before expiry. Seller shall not accept short expiry returns of less than six months. | |
| Payment:
| (a) The seller’s normal trading terms are cash in advance unless otherwise negotiated in writing. (b) Any returned cheques will incur bank and administration charges of Ksh. 3,000.00 which must be cleared before the resumption of supplies can take place. (c) Any amount outstanding for over 90 days shall be handled by the company’s appointed debt collector. The buyer shall meet such debt collection fees at 10% of all amounts outstanding. | |
| Force Majeure:
| The Seller retains the right to cancel any order contract if it cannot be compiled with by reasons of strike, riot, accident, fire earthquake, war government restrictions, licences, quotas, exchange control restrictions and or any other circumstances beyond the seller’s control. | |
| Dispute Resolution:
| Any disputes arising between the buyer and seller from above terms and conditions shall be subject to mediation. | |
